Terms and Conditions for “Near Ki Dukan” Platform

Please read these terms and conditions carefully before using the “Near Ki Dukan” platform (referred to as the “Platform”). By accessing or using the Platform, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, please do not use the Platform.

  1. Account Registration:
  • Shopkeepers must provide accurate and complete information during the registration process.
  • Each shop is assigned a unique shop ID, which serves as a direct link to the shop’s mobile app.
  • Shopkeepers are responsible for maintaining the confidentiality of their shop ID and account details.
  1. Subscription and Payments:
  • Shopkeepers must subscribe to the Platform to avail its services. The subscription fee covers app development, maintenance, and hosting.
  • The subscription cost and payment schedule will be specified on the Platform.
  • Payments made are non-refundable, and services will be provided based on the selected subscription plan.
  1. Shop Content and Products:
  • Shopkeepers are responsible for the accuracy and legality of the content and products displayed on their shop’s mobile app.
  • Shopkeepers must adhere to applicable laws and regulations regarding product listings, descriptions, and pricing.
  1. Privacy and Data:
  • The collection and use of personal data are governed by the Platform’s Privacy Policy.
  • Shopkeepers must respect user privacy and should not misuse any customer information collected through the app.
  1. Intellectual Property:
  • Shopkeepers retain ownership of their shop’s content and products.
  • The Platform and its components are protected by intellectual property laws and may not be reproduced or used without permission.
  1. Prohibited Activities:
  • Shopkeepers must not engage in any unlawful, fraudulent, or abusive activities on the Platform.
  • Any violation of these terms and conditions may result in suspension or termination of the shop’s account.
  1. Liability and Indemnification:
  • The Platform is provided “as is” and “as available.” The Platform is not responsible for any technical issues, interruptions, or errors.
  • Shopkeepers agree to indemnify and hold the Platform harmless from any claims, damages, losses, or liabilities arising from their use of the Platform.
  1. Modification and Termination:
  • The Platform reserves the right to modify, suspend, or terminate services at any time.
  • Shopkeepers can terminate their subscription at any time, but no refunds will be provided for partial subscription periods.
  1. Governing Law and Disputes:
  • These terms and conditions are governed by the laws of New Delhi, without regard to its conflict of law principles.
  • Any disputes arising from or relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of New Delhi.
